When Dangerous Property Conditions May Support a Claim
Premises liability claims arise when a hazardous condition causes an injury and there’s a legal basis for holding another party responsible. A hazard alone doesn’t establish liability. The visitor’s reason for being on the property, the nature of the condition, and the available evidence all affect whether a claim is viable.
We handle premises liability matters involving slip and fall injuries, dog bites, assaults connected to inadequate security, and accidents in public places. These incidents may occur at apartment buildings, retail stores, restaurants, office buildings, parking garages, private homes, or privately managed public spaces.
Hazards involved in these claims may include:
- Falling objects or materials that strike visitors
- Broken stairs, railings, flooring, or other building features
- Icy walkways and other dangerous walking surfaces
- Hidden hazards that visitors wouldn’t reasonably anticipate
- Inadequate security associated with an assault
Establishing property owner liability requires more than showing that an injury happened at a particular address. The analysis may include who owned or controlled the location, how long the condition existed, whether the responsible party knew or should have known about it, and what steps were taken in response.

How Massachusetts Premises Liability Standards Apply
Massachusetts generally requires property owners to use reasonable care under the circumstances for lawful visitors. This means taking the precautions a reasonably careful person would take in a similar situation. The state replaced the former legal categories of invitees and licensees with this broader standard for people lawfully on the property.
A premises liability claim generally requires evidence of four elements:
- Duty of Care: The responsible party owed the visitor a legal duty under the circumstances.
- Breach: The responsible party failed to meet the applicable standard of care.
- Causation: The breach caused or materially contributed to the injury.
- Damages: The person sustained measurable losses because of the incident.
The standard differs for trespassers. Property owners generally owe adult trespassers a duty to refrain from willful, wanton, or reckless conduct rather than the duty ordinarily owed to lawful visitors.
Children may receive separate protection under Massachusetts attractive nuisance law. An attractive nuisance is a hazardous property feature likely to draw children who may not understand its danger. Whether the doctrine applies depends on facts such as the child’s age, the nature of the condition, and the burden of addressing the risk.
These principles provide general legal information, not advice about a specific accident. When advising a client about an individual claim, we assess the visitor’s status, control of the property, the alleged hazard, and the connection between the condition and the injury.

Compensation & Filing Rules for Chelsea Injury Claims
Compensation in a premises liability claim depends on the injuries, liability evidence, available insurance coverage, and the circumstances of the incident. No category of loss or prior result determines what another person may recover.
Personal injury damages may address:
- Economic Damages: Medical bills, rehabilitation costs, and lost wages
- Non-Economic Damages: Pain and suffering, disfigurement, and diminished enjoyment of life
Massachusetts Filing Deadline
The statute of limitations is the deadline for filing a lawsuit. Massachusetts personal injury claims, including those arising from hazardous property conditions, generally must be filed within three years of the injury date. The precise deadline can depend on the parties and facts involved, so the general period may not control every case.
Massachusetts also recognizes a discovery rule in some circumstances. The rule may delay the start of the limitations period if the harm and its cause couldn’t reasonably have been detected immediately. Its application is fact-specific and shouldn’t be treated as an automatic extension.
How Shared Fault Affects Compensation
Massachusetts follows modified comparative negligence, which assigns percentages of fault when more than one party contributed to an injury. A person found 51% or more at fault can’t recover damages. Someone found 50% or less at fault may recover, but the award is reduced by that person’s share of responsibility.
For example, an injured visitor could face an allegation that a hazard was visible or that the visitor failed to act carefully. That allegation doesn’t decide the claim by itself. The evidence and allocation of fault determine its legal effect.
