No-Fault States and Liability

In a no-fault state like Massachusetts, if you are injured in a car accident caused by a drunk driver, your own insurance company will pay for your medical expenses and certain other expenses related to your injuries, regardless of who was at fault for the accident. This is because PIP coverage is still applicable, regardless of whether the other driver was intoxicated.

However, if your injuries are severe or your medical expenses exceed the limits of your PIP coverage, you may be able to file a lawsuit against the drunk driver. In this case, you would need to show that the other driver's intoxication was the cause of the accident and your injuries.

Massachusetts law also allows injured parties to seek compensation for additional damages in cases where the driver who caused the accident was operating under the influence of drugs or alcohol.
